·        Mrs. Urdvardy, a music teacher, downloads MP3 files from the Web and uses them to instruct her students in the various kinds of music. She allows students to copy the files and take them home, listen to them and complete a worksheet.

Using MP3 files is not always a bad thing.  If you download the MP3 files from the web you want to use MP3.com, they paid for their files.   This makes the process of downloading from the MP3.com site legal.  If you are going to use other sites it is advised that you use caution in determining if a download has been paid for or not.  This activity is permitted and legal as long as the MP3 was purchased before being used.

Under the Fair Use Guidelines, which are just guidelines, it states that a teacher may only make single copies.  A teacher cannot make multiple copies of workbooks for the students use.  It is not a good idea for Mr. Hamer to make copies of the workbook for students to use.  If he would copy the book for seven students, what would stop him from next year ordering only one book and making 26 copies.  It is in Mr. Hamer’s best interest to not copy the workbooks for the seven students. He should have students work together in groups and order more copies of the workbooks as soon as possible.
